1. Agreement to Terms
By accessing our website, purchasing a subscription plan, or commissioning work from THEMONOLITH.NETWORK ("Monolith", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not utilize our services.
2. Description of Services
Monolith engineers custom digital infrastructure for businesses, including bespoke Next.js websites, CRM pipeline setups, automated email/messaging flows, AI-assisted lead qualification, and managed cloud hosting across our Foundation, Growth, and AI Operations plans.
3. Subscription Plans, Billing & Cancellations
- Setup Fees & Recurring Subscriptions: Plans involve an upfront one-time engineering setup fee and an ongoing monthly subscription billed via Paystack in ZAR (at current exchange rates).
- Pause or Cancel Anytime: You may pause or cancel your subscription at any time prior to the next monthly renewal. No long-term lock-in contracts or termination fees apply.
- Refund Policy: Due to the bespoke allocation of engineering labor and custom code development, setup fees are non-refundable once engineering build work commences. Monthly subscription fees cover active ongoing hosting and continuous support.
4. Intellectual Property & Deliverables
Upon receipt of full payment for setup and active subscription fees, the client owns all bespoke custom content, proprietary copy, and design assets produced specifically for the client's project.
Monolith retains all rights, title, and interest in its proprietary background technology, pre-existing code modules, deployment tools, internal workflows, and generalized AI pipelines.
5. Hosting, Maintenance & Service Level
Managed hosting and ongoing maintenance are provided for active subscribers. While we target 99.9% platform availability, scheduled maintenance or third-party upstream infrastructure interruptions (e.g., DNS, CDN, payment gateways) may occasionally occur. Monolith will use commercially reasonable efforts to promptly restore services.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Monolith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of or inability to use our services.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.
